Executive verses Judiciary Tussle and its impact on Justice System In Kenya

There has been a serious tussle between the executive arm of government and the Judiciary in Kenya. This became noticeable after the judiciary for the first time nullified the presidential elections in 2017. Since then, executive has been seen to constantly operating in disregard to most of the court orders. Very recently the president refused to appoint some of the judges presented to him by the Judicial Service Commission, contrary to the law. This came a few weeks after high court declaring the clamor to amend the constitution through the BBI initiative null and void. There is a great fear that the executive’s disregard to court orders has a potential impact on justice system in Kenya and could even plunge the country into chaos. This made it necessary to organize an interview with legal minds to discuss the impact of this tussle on justice system in Kenya.
