Assesing the limit of state power in Kenya and other African states

It is frequently asserted that no one is above the law, meaning that everyone should be treated equally and fairly by the law. Having said that, for a law to be thus effective, it must be made by the people openly and transparently, and the legislative, executive and judicial branches must have distinct authorities. Also open to open and unrestricted criticism should be the legislation and how it is applied. Additionally, laws must be understandable and available. There shouldn't be any retroactive legislation enacted, and trials should be fair and quick. Without any presumption of innocence, the law should be transparent, fair, and independent. People should only be punished in conformity with the law in fair and timely trials. Legitimate litigants should be government agencies.
